Get Bent Florida is not responsible for material submitted to this site or posted in chat rooms, bulletin boards or message boards by site users.
By communicating with the this site, however, users grant Get Bent Florida permission to use any information, pictures, suggestions, ideas, drawings or concepts communicated for any purpose Get Bent Florida chooses, commercial, public or otherwise, without compensation whatsoever.
1) Registration to Get Bent Sportfishings, Get Bent Florida's Forum is FREE! However as a result we strictly enforce the rules and policies contained here along with our Terms of Service.
2) As you noticed you had to enter your date of birth to get to this point. Entering incorrect information in that field is grounds for immediate membership termination. This process keeps us in compliance with required COPPA rules and regulations.
3) Although we (Get Bent Sportfishing & Get Bent Florida Staff) will attempt to keep all objectionable messages off this forum, it is impossible for us to review all messages and photos. All messages express the views of the author, neither the owners of Get Bent Sportfishing, Get Bent Florida, its agents or affiliates will be held responsible for the content of any message.
4) Your acceptance of these terms warrants that you will not post any message(s) that are obscene, vulgar, sexually-orientated, hateful, racial, threatening or otherwise violating of any laws. If you are found guilty of doing any of these your account can be immediately suspended or terminated without notice to you.
5) Website links to a resource, historical or technical nature are permitted.
- However special attention should be paid to ensure that no copyrighted material is posted here without the permission of the other sites Owner first.
- You are allowed to link to information and article as long as the other site being linked to permits it.
6) Links of a spamming nature to direct traffic to yours or anothers site, to take members from this site, for personal or financial gain is strictly forbidden and will not be tolerated. There are appropriate methods of doing this with the Administrators approval. Should you be found to have done any of these without Administration approval your account will be terminated without right to appeal.
7) NO FORUM BASHING. Forum bashing is simply complaining about other forums, their operations, rules, moderators, members, practices, etc. Frankly we are committed to making THIS SITE & FORUM a premier site within the fishing community and do not have time to hear or worry about the operations of others. Our efforts are better spent on managing our site & forums and building a GREAT community of members.
8) OFFENSIVE POSTINGS. Users who feel that a posted message is offensive are encouraged to contact any forum moderator, administrator or the Forum Boss immediately via e-mail or private message. We will make every effort to address reports of offensive postings as soon as possible and take appropriate action. Any member making such a report will remain anonymous.
9) NO FLAMING / MEMBER BASHING. When posting messages, members will avoid "Member Bashing", "Flaming" or whatever else you wish to call it. This behavior will not be tolerated and may result in your account being suspended or terminated without notice. Member Flaming and Bashing includes but are not limited to the following:
(i) Personal Attacks
(ii) Name Calling (including negative slights)
(iii) Founded or Unfounded Accusations
(iv) Racist Remarks
(v) Communications of Threats
(vi) Harassing Messages
(vii) Discrimination
(viii) Inflammatory
(ix) Degrading
10) VIOLATIONS: Any violations of the User Agreement will be recorded and forwarded to all Moderators, Administrators and the Forum Boss for review, with no expectation of immunity. Violations may result is suspension and/or termination of your account.
11) PORNOGRAPHY: Posting of any type of pornography (nudity, sexual acts, sexual simulations or representations, sexually explicit language, etc.) is forbidden. This is a family oriented site with underage/minor children on this site. KEEP IT CLEAN!
12) NO TROLLING: Trolling is someone that posts messages specifically designed to provoke a negative response from other members, in order to gain publicity or attention. There will also be NO ATTACKS of a particular race, sex, religion, sexual orientation, or other group of people.
13) PRIVATE MESSAGES (PM): If you are reported by another member or staff of sending harassing or otherwise abusive Private Message(s) you will be subject to investigation up to and including the tracking and reading of your private message(s) in question and those private message(s) will be used in the determination of action taken to your account.
14) HARASSMENT: Harassment is defined as uninvited and unwelcome conduct directed at any member of our forums, using any means of communication provided by the Get Bent Florida Site & Forums. Should you have issues with the site or any of its members, please contact the Administrator directly. Do not under any circumstances take it upon yourself to address the issue, whether that be contacting the member or by addressing the issue on the forums.
15) FAKE POSTS: Posting of intentional misleading information or images is highly unsuggested as this is one of the common ways that flame wars are started (which are against the rules). If you make a fake post and it creates a problem, flame war or other negative issue then your account can be suspended or terminated immediately. Not to mention you will lose all credability with other members.
16) The owners of Get Bent Florida and its agents reserve the right to remove, edit, move or close any thread for any reason. Owners, Administrators, Moderators, the Forum Boss and agents of Get Bent Florida are here to provide and keep this site and its forums a great place for everyone to enjoy.
17) The information, pictures and graphics contained on this site are protected under copyright laws and are the exclusive property of Get Bent Florida a subsidiary of Get Bent Sportfishing. In some cases Get Bent Sportfishing has been given the permission to use material that is on this site (Please see "Terms of Service / Legal" page). 18) INTELLECTUAL PROPERTY: It is the policy of Get Bent Florida to respond expeditiously to claims of intellectual property infringement. Get Bent Florida will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA"). Should a violation of intellectual property be discovered, the document(s) or messages in such violation will be removed in a timely manner after any and all investigating has been completed to prove the authenticity of such a claim.
19) INDEMNITY: You agree to indemnify and hold Get Bent Florida its founders, staff and agents, harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the web site, your use of the web site, your connection to the web site, your violation of the Terms Of Service, or your violation of any rights of another.
Under no circumstances, including but not limited to negligence, will Get Bent Florida be liable for special or consequential damages that result from the use or inability to use the materials in this site. In no event shall Get Bent Florida's liability to a user for any loss, damage or claim exceed the amount paid by the user for accessing this site.
This agreement is effective until terminated by either party. You may terminate this agreement at any time by discontinuing your use of the Get Bent Florida site and destroying all materials obtained from it.
20) LIMITATION OF LIABILITY:
You expressly understand and agree that Get Bent Florida shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Get bent Florida has been advised of the possibility of such damages), resulting from:

(iii) the results that may be obtained from the use of the service will be accurate or reliable,
(iv) the quality of any products, services, information, or other material purchased or obtained by your through the service will meet your expectations, and
(v) any errors in the software will be corrected.
c. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data with the results from the download of any such material.

22) USER CONDUCT: Users agree not to use the site for sale, trade or other commercial purposes. Users may not use language that is threatening, abusive, vulgar, discourteous or criminal. Users also may not post or transmit information or materials that would violate rights of any third party or which contains a virus or other harmful component. Get Bent Florida reserves the right to remove or edit any messages or material submitted by users.
You acknowledge that Get Bent Florida does not prescreen content, but that Get Bent Florida and its designees shall have the right (but not the obligation) in their sole discretion to refuse, move or remove any content that is available via the web site. Without limiting the foregoing, Get Bent Florida and its designees shall have the right to remove any content that violates the Terms Of Service or is otherwise objectionable.
